This SMS Messaging Terms & Privacy Policy Addendum ("SMS Terms") supplements the Terms of Service and Privacy Policy of PDQuick Enterprises, LLC ("PDQuick," "we," "us," or "our").
These SMS Terms address three categories of messaging:
The business identified as the sender of a particular messaging program is responsible for obtaining the consent required for that program. The roles of PDQuick, participating merchants, HMS, and other technology providers may vary according to their contractual arrangements.
PDQuick may send text messages to customers, prospective customers, and authorized business representatives who have provided the consent required for the applicable communications.
Messages may include:
PDQuick will identify itself as the sender in accordance with applicable messaging requirements.
Consent to receive promotional messages is voluntary and is not a condition of purchasing products or services.
PDQuick may offer, recommend, facilitate, or support cloud-based business management applications provided by HMS and its technology partners.
Certain applications may include SMS capabilities for customer engagement, appointment scheduling, service notifications, order updates, reminders, and other business communications.
Participating Business Responsibilities
Businesses using these applications are responsible for:
Technology Provider Responsibilities
HMS and its applicable technology providers may establish additional requirements governing messaging functionality, acceptable use, delivery, privacy, and program registration.
Those requirements may apply independently of these PDQuick SMS Terms.
The participating business must review and comply with applicable provider agreements and messaging policies.
PDQuick does not independently guarantee delivery, availability, or legal compliance of SMS campaigns operated by participating businesses.
Nothing in these Terms eliminates obligations that PDQuick may have under applicable law or its own contractual commitments.
Participating restaurants may use PDQuick-supported online ordering technology to communicate with customers concerning their orders.
Depending on the restaurant's configuration, messages may include:
These messages relate to a customer's transaction with the participating restaurant.
The restaurant must obtain any consent required for these communications and provide appropriate disclosures at checkout or through another lawful enrollment method.
Participating restaurants may offer separate promotional messaging programs where supported by their technology and applicable agreements.
Promotional messages may include special offers, coupons, loyalty promotions, and marketing announcements.
Customers must provide the level of consent required by applicable law before receiving promotional messages.
Placing an online order does not automatically enroll a customer in a restaurant's promotional SMS program.
Consent to receive restaurant messages does not authorize unrelated marketing messages from PDQuick or other participating businesses.
Each participating restaurant is responsible for its own SMS campaign content, required disclosures, consent records, customer communications, and compliance obligations.
PDQuick may provide technical functionality, integration assistance, and support consistent with the applicable service agreement.
Recipients must provide the consent required for the particular messaging program.
Consent may be obtained through appropriately disclosed website forms, checkout processes, electronic enrollment, keyword subscriptions, or other lawful methods.
Where required, consent must be affirmative, specific to the identified sender and messaging purpose, and documented.
Marketing consent must not be inferred solely from an existing customer relationship, order placement, or submission of a telephone number.
Consent to receive marketing SMS messages is not a condition of purchase.
Message frequency varies according to the selected program and customer activity.
Recurring messaging programs will disclose the applicable frequency information during enrollment.
Message and data rates may apply according to the recipient's wireless carrier plan.
PDQuick does not control charges assessed by wireless carriers.
Recipients may opt out of an SMS messaging program at any time.
Reply STOP to the applicable program's text messages to request that messaging stop.
Requests using other recognized opt-out language, including CANCEL and UNSUBSCRIBE, or another reasonable method of revoking consent, will be honored as required by law.
Opt-out requests will be processed promptly and within applicable legal deadlines.
A final confirmation message may be sent where permitted.
An opt-out applies to the messaging program or sender covered by the request, subject to applicable legal requirements.
Recipients who wish to stop messages from multiple independent businesses may need to opt out of each applicable sender's program.
For assistance, reply HELP to the applicable SMS program where supported.
