Welcome to the PDQuick ordering platform. These Terms of Service (“Terms”) govern your access to and use of the online ordering system provided by PDQuick Enterprises, LLC (“PDQuick,” “we,” “us,” or “our”) on behalf of the Restaurant displayed on this ordering site (“Restaurant”).

Please read these Terms carefully before using the service. By accessing or using the Site and placing orders through it, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

PDQuick Enterprises, LLC provides an online platform that enables you (“User,” “you,” or “Customer”) to interact with a participating Restaurant to place orders for pickup, dine-in, or delivery. Additional terms or conditions may be provided by the Restaurant and govern your purchase. We recommend contacting the Restaurant directly with questions or concerns related to their operations, including menu items, pricing, fulfillment, or refunds.

Modifications to Terms

We reserve the right to revise these Terms at any time. Updates will be posted with a revised “Last Updated” date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

About the Service

PDQuick provides technology that facilitates online ordering between Customers and Restaurants. PDQuick is not responsible for the fulfillment, preparation, quality, pricing, delivery, or refund of any orders. PDQuick only manages the technical ordering infrastructure.

Restaurants remain solely responsible for all aspects of order fulfillment, and users are encouraged to contact the Restaurant directly for any concerns.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are of legal age and capable of entering into a binding agreement; 
• You will comply with all applicable local, state, and federal laws and regulations; 
• You are using the Service for lawful purposes only; 
• If acting on behalf of a business or legal entity, you are authorized to bind that entity to these Terms.
   

Payment and Transaction Terms

When you place an order, your payment information is processed through third-party payment processors. PDQuick does not directly store credit card information but will take reasonable measures to protect it where temporarily handled or stored by integrated providers.

You are responsible for the accuracy of all order and payment information submitted. Once an order is confirmed, it may not be canceled or altered. Any questions regarding your order, including disputes or refund requests, must be directed to the Restaurant.

PDQuick is not liable for unauthorized access to or misuse of your personal or payment information by the Restaurant or other third parties outside of our control. We recommend reviewing the Restaurant’s privacy and refund policies directly.

By placing an order through the Service, you consent to receive communications from PDQuick Enterprises and/or the Restaurant related to your transaction. These may include emails, calls, texts, or push notifications for purposes such as confirming your order, providing updates, delivery status, or follow-up communications. Message and data rates may apply depending on your carrier plan.

To opt out of non-essential communications (such as promotional content), you may follow the unsubscribe instructions provided or contact us at support@pdquick.net. However, certain transactional communications related to your order may still be necessary.

All content on the Service, including text, graphics, logos, images, software, and design elements, is the property of PDQuick Enterprises, its licensors, or content suppliers, and is protected under United States and international copyright, trademark, and intellectual property laws.

Except as explicitly permitted under these Terms, no part of the Service may be copied, modified, distributed, republished, uploaded, posted, publicly displayed, or transmitted without PDQuick’s prior written consent.

PDQuick grants you a limited, non-transferable, non-exclusive, revocable license to access and use the Service for personal and non-commercial purposes, subject to compliance with these Terms. We reserve the right to suspend or terminate your access at any time, for any reason, including suspected violations of these Terms.

You may not:

• Use the Service for any unlawful or unauthorized purpose; 
• Copy, distribute, or alter any part of the Service without written permission; 
• Access the Service using automated tools (e.g., bots, scrapers) without authorization.
   

You agree not to:

• Use the Service for any purpose prohibited by law or these Terms; 
• Transmit malicious software or harmful code; 
• Misrepresent your identity or relationship to a third party; 
• Interfere with the operation of the Service or others’ enjoyment of it; 
• Attempt to gain unauthorized access to the Service, its servers, or related systems. 

Violations may result in suspension or permanent revocation of your access, and may be subject to legal action.

The Service may contain links or references to third-party websites or services. PDQuick does not control and is not responsible for the content, privacy practices, or accuracy of any third-party content or websites. Your interactions with those third parties are solely between you and the third party, and we encourage you to review their respective terms and privacy policies.

Your notice must include:

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, either express or implied. PDQuick Enterprises makes no warranties or representations regarding the accuracy, completeness, reliability, or availability of the Service or any content therein.

To the fullest extent permitted by law, PDQuick disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement; 
• Warranties arising from course of dealing or usage of trade; 
• Any guarantee that the Service will be uninterrupted, error-free, or secure. 

Use of the Service is at your own risk.

To the fullest extent permitted by applicable law, PDQuick Enterprises, including its directors, officers, employees, contractors, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from or related to your use of or inability to use the Service.

Our total liability for any claim related to the Service will not exceed the amount paid by you, if any, to us for use of the Service during the twelve (12) months prior to the event giving rise to the claim.

Some states do not allow certain limitations on implied warranties or damages, so these exclusions may not apply to you in full.

You agree to defend, indemnify, and hold harmless PDQuick Enterprises and its officers, employees, affiliates, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Service; 
• Your violation of these Terms; 
• Your violation of any rights of a third party, including any intellectual property or data privacy rights; 
• Your misuse of any Restaurant’s products or services. 

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate in such defense as reasonably requested.

We may retain certain information and data you transmit to the Service to manage operations, comply with legal obligations, or support business analytics. Although we perform routine data backups, we are not responsible for any loss or corruption of user data. By using the Service, you waive any claims relating to such data loss.

Before initiating any formal dispute resolution, you agree to contact us to attempt to resolve any issue informally.

If informal resolution fails, both parties agree to resolve any disputes arising out of these Terms or the use of the Service through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Maricopa County, Arizona, unless otherwise required by law.

Exceptions to Arbitration:
You or we may bring claims in small claims court or seek injunctive or equitable relief for intellectual property infringement or unauthorized access to the Service.

Waiver of Class Actions:
All claims must be brought on an individual basis. You waive any right to participate in class or representative actions or consolidated proceedings.

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. Any legal action not resolved through arbitration shall be brought in a court of competent jurisdiction in Maricopa County, Arizona.

By using the Service, you consent to receive communications from us electronically. You agree that electronic communications—including agreements, notices, disclosures, and other documents—satisfy any legal requirements for written communications.

You also consent to the use of electronic signatures and records in connection with your use of the Service.

• Entire Agreement: These Terms and our Privacy Policy and Addendum (below) constitute the full agreement between you and PDQuick regarding the Service. 
• Severability: If any provision of these Terms is found unenforceable, the remainder will remain in full force and effect. 
• Waiver: Our failure to enforce any part of these Terms does not constitute a waiver of our rights. 
• Force Majeure: We are not liable for any delay or failure in performance due to causes beyond our reasonable control. 
• Assignment: You may not assign your rights under these Terms. We may assign our rights at any time.

PDQuick uses commercially reasonable safeguards to protect your data against unauthorized access, loss, or disclosure. Your mobile number and associated personal information will be retained only for as long as necessary to support your use of the Service or as required by law.

We do not sell, rent, or share your SMS data, including your phone number or message history, with third parties for promotional or marketing purposes.

All data sharing provisions in our general Privacy Policy exclude mobile opt-in data, which is kept entirely confidential.

By providing your mobile number and opting into SMS communications, you agree to receive automated and/or manual messages from PDQuick Enterprises. Consent is not a condition of purchase. You may opt out at any time.
